These Terms of Service (“Terms”) govern your use of the Hopping Words desktop application (“the App”), including versions for Microsoft Windows and macOS, provided by K. Melsh Innovative Software, Inc., incorporated in British Columbia, Canada (“we,” “us,” or “our”).
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal or internal business purposes, subject to these Terms. Except where applicable law provides otherwise, you may not copy, modify, distribute, sell, or lease any part of the App, nor reverse engineer or decompile it or extract any software components from it.
You may obtain and use the free version of the App without a subscription, subject to these Terms. The free version includes only a subset of the features available in the full version.
Our descriptions of the App on our website and elsewhere may describe the capabilities of Hopping Words generally. Some of those capabilities are available only in the full version.
For example, the free version currently does not include use of the App's special copying function with browsers or word processors as source applications, and it does not include access to the AI feature. The features available in the free version may change from time to time.
Purchasing a subscription or receiving a referral reward gives you access to the full version of Hopping Words. This includes access to all features currently available in the App. For example, full version access currently includes the use of a range of common browsers and common word processors as source applications for the special copying function of the App. Full version access currently also includes access to the AI feature of the App. It is our intention to continue making these features available as part of the full version of the App, although some features may change, be added, or become unavailable due to technical, legal, or other circumstances.
The AI feature currently requires (a) full version access and (b) AI credits. Some amount of AI credits are consumed each time the AI feature is used. AI credits are included with all subscriptions and with certain referral rewards. Additional AI credits can be purchased. AI credits are currently available only to users who have full version access.
AI-generated output may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing AI-generated output before relying on it.
We reserve the right to select and change the AI provider and the AI model without notice to you.
AI services depend on third-party providers and may occasionally be unavailable, delayed, or subject to usage limits. Temporary interruptions do not constitute a failure of the App and do not entitle you to compensation beyond any rights provided under applicable law or under the Refund Policies named in section 10.
Full version access – through a subscription or through a referral reward – requires signing up with Hopping Words, which creates an account for you with us.
Hopping Words employs the external platform WorkOS for sign-up and sign-in. Signing up and signing in may require providing your email address, confirming it, providing a password or alternatively providing credentials of your Google or Microsoft account. You are responsible for the accuracy of the information provided.
Information processed through WorkOS is handled in accordance with WorkOS's Privacy Policy (at https://workos.com/legal/privacy). You agree to us saving your email address in connection with your account.
When you have an account, you will by default remain signed in. The App includes options for signing out and signing in manually. The App may require you to sign in again to access your account data in case it encounters problems.
If you have full version access, it is tied to your account, and thus to the email address and other credentials with which you signed up.
If you have full version access, you are allowed to activate it on up to three of your computers, but not more. You activate it on a new computer by installing Hopping Words and signing in with the email and credential that you first used to sign up.
You may purchase a monthly, yearly, or lifetime subscription to obtain full version access for the duration of the subscription. Each subscription includes some AI credits, as specified on the page on which you select a subscription. Additional AI credits are available for purchase.
Subscriptions are currently purchased from within the App.
After you purchase a subscription, you receive a confirmation email. It contains a link for cancelling the subscription.
Monthly and yearly subscriptions renew automatically unless canceled. A cancellation takes effect with the end of the billing period during which the cancellation is made, unless it is made less than an hour before the end of a billing period, in which case it may take effect with the end of the next billing period. The billing periods for this are currently calculated in UTC time.
In a lifetime subscription, "lifetime" refers to the commercial lifetime of the App.
Additional AI credits can currently be purchased from within the App.
Purchases of a subscription or of an AI credit package are processed by our online reseller Paddle. Paddle requires certain information from you for processing the payment and for their tax obligations. You are responsible for the accuracy of the information you provide. Paddle stores this information in accord with their Privacy Policy (at https://www.paddle.com/legal/privacy). You agree to Paddle forwarding your country to us for our evaluation of the geographical distribution of our customers.
The prices may be shown in U.S. dollars (USD) in the App and on a product selection web page. They are shown in your currency on the final payment pages before you commit to your purchase.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle also provides all customer service inquiries related to the order process and handles returns.
Refunds are handled by Paddle in accord with Paddle's Refund Policy (at https://www.paddle.com/legal/refund-policy) and our Refund Policy (at https://hopping-words.com/web/legal/refund_policy.html), which clarifies how Paddle's Refund Policy applies to Hopping Words.
The App currently allows for referrals of Hopping Words with a reward of one month of full version access for both sides. While the referral program is offered, it is subject to the following rules:
We reserve the right to pause or end the referral program in response to security problems, security concerns, or other problems we may experience with it.
We may offer updates of the App to improve performance, security, or functionality. You can find available updates through our website https://hopping-words.com. Updates will require manual installation by you.
Paddle's payment pages include a checkbox that allows you to opt in to receiving marketing emails from us. If you opt in, we will use that consent only to send occasional emails about major updates to Hopping Words or other significant developments relating to Hopping Words.
Each marketing email will include a way for you to unsubscribe from future marketing emails.
We handle your information in accordance with our Privacy Policy at hopping-words.com/legal/privacy_policy.html.

We reserve the right to suspend or terminate your account for serious or repeated violations of these Terms. Upon termination, any remaining entitlement to full version access and any unused AI credits will be forfeited. We may also refuse to create a new account for you in the future. Any payment obligations that arose before termination remain unaffected.
The App is provided “as is” and “as available.” We make no warranties, express or implied, regarding performance, reliability, or fitness for a particular purpose. You use the App at your own risk.
The App's special copying functionality passes extracted or summarized text through your computer's clipboard. Other applications running on your computer, including malicious software, may be able to access information stored in the clipboard. We are not liable for losses, damage or harm resulting from malware installed on your computer and its interaction with the functionality of the App.
To the fullest extent permitted by law, our total liability for any claims arising out of or relating to your use of the App shall not exceed the amount you paid for the App during the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
We may revise these Terms, our Privacy Policy, or our Refund Policy when we release updated versions of the App. Users with an account will receive reasonable advance notice by email of policy revisions that are more than minor editorial or administrative corrections.
Reasons for revisions may include new features of the App, new security concerns, and unclear formulations we were not previously aware of. The changes will not reduce your remaining period of full version access or the AI credits that you have already acquired.
If you do not agree to the revised policies, you must stop using the App before they become effective. For users with an account, continued use of the App after the effective date of policy revisions constitutes acceptance of the revised policies, except where applicable law requires a different form of consent.
If you believe that a revised policy creates an unexpected problem for you, we welcome your feedback. Your feedback may help us improve future revisions or identify an appropriate solution for your particular situation.
If you are using the free version of the App and do not have an account, we will ask you to agree only to the Terms accompanying the version of Hopping Words that you download or update to.
We may assign or transfer our rights and obligations under these Terms to another company, including in connection with a merger, acquisition, sale of assets, or transfer of ownership.
If Hopping Words or its operating company changes ownership, your use of the service may continue under the new owner subject to these Terms and applicable law.
We reserve the right to modify, suspend, or discontinue the service.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, excluding conflict-of-laws rules. Any dispute shall be resolved in the courts located in British Columbia, Canada.
